Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (referred to as the “lessee”) and Otherhome (referred to as the “lessor”). These Terms govern your use of the Otherhome Platforms, which include websites, applications, and other offerings provided by Otherhome. In these Terms, “Otherhome,” “lessor,” “we,” “us,” or “our” refer to the entity you are contracting with, while “tenant,” “lessee,” “user,” or “you” refer to the entity we are contracting with.

Otherhome provides shared housing services in Adelaide, offering customer service, maintenance, and property management. Through our platform, landlords can rent out their properties. To access our services, you must register an accurate and up-to-date account on our website.

Tenant Terms

1. User Obligations

1-1. By using the Otherhome Platform, you agree to comply with all applicable laws, regulations, and the provided terms.

1-2. You are responsible for providing accurate and complete information during registration and when providing information about a rental property.

1-3. You must maintain the confidentiality of your account information and promptly notify Otherhome of any unauthorised use or security breaches.

2. General Rent Conditions

2-1. Rent Payment: Rent must be paid on time. Failure to pay rent arrears of more than 2 weeks without prior discussion with our finance team will result in contract termination, and the security bond will not be refunded.

2-2. Electricity Usage: Electricity usage will be shared among tenants and paid regularly based on the agreements between Otherhome and the energy provider.

2-3. Extended Vacancy: If you need to vacate the room for longer than 28 days (4 weeks), you must notify us via support@yydpni9u.dreamwp.com or Otherhome Ticket page and pay the rent upfront before leaving. Failure to notify us may result in lease termination.

2-4. Contact Details: Immediate notice or update is required when your contact details change. Failure to provide updated information may lead to associated issues for which we do not take responsibility.

3. Termination of Lease

3-1. Early Termination: Early termination requires prior discussion. Rent must be paid until the lease end date unless a new tenant is found. Otherhome assists in finding a new tenant and deducts a $200 administration fee from the lessee’s bond.

3-2. Written Termination Notice: Both fixed-term and periodic-term leases require a written notice of 14 days in advance, sent to support@yydpni9u.dreamwp.com or the Otherhome Ticket page.

3-3. Periodic Lease: Tenants must notify Otherhome at least two weeks in advance to extend or terminate the contract. Failure to update leads to automatic transfer to a periodic contract with a $10 per week fee. Rent increases by $10 per week for up to three months on a periodic contract, followed by a new fixed-term lease agreement. Review and understand these terms before signing the lease agreement.

3-4. Room Transfer: For room or premises changes, contact your Property Manager via support@yydpni9u.dreamwp.com or the Otherhome Ticket page. A $200 administrative fee applies for personal transfers.

4. Cleaning

4-1. Weekly Cleaning: Tenants will be assigned weekly cleaning duties for common areas and must upload photos of the cleaned area on the Otherhome group chat.

Areas to Clean: Kitchen, common living areas, bathrooms (excluding ensuites), and individual rooms.

5. Tenant’s Responsibility

5-1. Immediate Lease Termination: Otherhome may immediately terminate the lease for issues such as racism, assault, violence, drugs, and unapproved pets/children.

5-2. Lease Termination: Otherhome may terminate the lease for issues such as rent arrears, indoor smoking, failed cleaning, unapproved guests, and noise disturbances. Warning letters are sent as a final chance before lease termination.

  • Rent Arrears and Violations: Warning letters for one week of rent arrears, lease termination for arrears exceeding two weeks.
  • Smoking: Indoor smoking is strictly prohibited.
  • Failure to Clean: Consistent refusal or failure to clean may result in a warning, followed by lease termination and a cleaning fee of up to $150 if professional cleaning services are required.
  • Guest Invitation: Guests require permission and prior notification. They can stay for up to 3 hours, but overnight stays are not allowed.
  • Noise and Disturbances: Quiet hours are observed from 10 pm to 7 am.

Note: Warning letters are intended to provide an opportunity for improvement before lease termination.

 

General Terms

1. Otherhome Responsibility

1-1. Service Provision: Otherhome operates as a rooming agency during business hours (weekdays, 9:30 AM to 5:30 PM, excluding weekends and public holidays).

1-2. Maintenance and Repairs: Otherhome promptly addresses maintenance and repair requests. Some issues may require landlord approval, which may result in longer response times. Efforts are made to expedite approvals and keep tenants informed.

1-2-1. Entry into common areas during repairs or inspections does not require prior notice. (Notice required for individual rooms.)

1-2-2. Emergency Contact: For life-threatening emergencies (fire, theft, flooding, etc.), contact us at +61 448 496 534. Non-emergency issues may not be addressed through this contact.

1-3. Compliance: Otherhome ensures compliance with applicable laws and regulations regarding the rental property and tenancy.

1-4. Security and Privacy: Tenant information is protected and handled in accordance with data protection laws.

1-5. Communication: Regular updates and notices are provided to tenants regarding the property, lease, and other relevant information.

2. Installation of CCTV cameras

2-1. Privacy: CCTV cameras are installed for security purposes to prevent crime.

2-2. Coverage: Cameras are placed in public areas only, not in private spaces such as bedrooms or bathrooms.

2-3. Recording: Footage is stored for up to one week and then automatically deleted.

2-4. Access: Recorded footage can only be accessed by authorized personnel and is provided to tenants with valid reasons, such as police investigations.

2-5. Maintenance: Otherhome maintenance team regularly inspects and maintains the CCTV cameras.

2-6. Legal Compliance: CCTV installation follows local laws. Otherhome is not liable for camera issues due to battery or machine malfunctions.

3. Otherhome Messenger

3-1. Instructions: Detailed instructions on app usage and its importance will be provided by the Property Management Team.

3-2. Account Creation: Otherhome Property Management Team creates an account for tenants using their provided email.

3-3. Download and Login: Tenants must download the Otherhome Messenger app and log in using the provided ID and password.

3-4. Group Chat: Tenants must join to the relevant house group chat based on their lease agreement (e.g., houseXX).

3-5. Communication: Important information, such as electricity bills and cleaning schedules, will be shared through the group chat. Failure to use the app may result in the tenant being held responsible for any consequences.

4. Marketing Use of Personal Information

Otherhome may use tenants’ personal information (name, email, phone) for marketing purposes. Tenant consent is assumed by providing this information. Otherhome protects privacy and complies with relevant laws.

 

5. Loss and Theft

5-1. Lost Keys: A $150 fee will be charged for key replacement, including knob installation if necessary.

5-2. Lost Electronic Fob: A $150 fee will be charged for key copy and delivery.

5-3. Lockout Assistance: For non-emergency lockouts between 10 am and 5 pm, a $100 attendance fee will apply, subject to availability. After hours, weekends, or holidays may require the assistance of a locksmith or tenant.

5-4. Theft Prohibited: Stealing others’ property will result in immediate lease termination and possible charges for missing items and damages.

 

6. Miscellaneous

6-1. Check-out Condition: Facilities should be left in the same condition as during check-in.

6-2. Damages and Expenses: Shared expenses for faults, damages, malfunctions, or breakages, including shared facilities.

6-3. Room Damages: Tenants are responsible for any damages to room features.

6-4. Cleaning Responsibility: Tenants must clean their room, en-suite bathroom (if applicable), storage, fridge, and furniture before check-out.

6-5. Check-Out Process:

▪️ Check-out time is 10 am on the last day of the tenancy.

1) Discard bedding, including the quilt and pillows provided by Otherhome and send at least 8 room photos to support@yydpni9u.dreamwp.com. Additional cleaning may incur a fee of up to $150.

2) Deduct outstanding electricity bills from the bond.

3) Provide bank details for deposit refund on the last Tuesday of each month.

4) Leave key on desk and send us a photo. Unlock the room door to avoid fees ($150 key cutting and replacement door).

5) Clean fridge and pantry area and send us photos. Failure to do so may result in a $50 cleaning fee.

 

🔲 Otherhome reserves the right to modify these Terms at any time. Your continued use of the platform implies acceptance of the revised Terms.

🔲 These Terms, along with any additional applicable terms, constitute the entire agreement between you and Otherhome, superseding all prior communications.

3. Termination of Lease

3-1. Early Termination: Early termination during the fixed-term contract must be discussed in advance. The lessee must pay rent until the lease end date unless a new tenant is found. Otherhome will assist in finding the next tenant and $200 of the associated administration fee including advertisement, open inspection and marketing will be deducted from the lessee’s bond.

3-2. Written Termination Notice: A written lease termination notice must be given 14 business days in advance and sent to support@yydpni9u.dreamwp.com or the Otherhome Ticket page. This applies to both fixed-term and periodic-term leases.

3-3. Periodic Lease: Tenants must notify Otherhome, with a minimum of two-weeks notice, whether they intend to extend or terminate the contract by the end of the fixed contract period. Failure to provide an update will result in automatic transfer to a periodic contract with an additional fee of $10 per week. On a periodic contract, tenants must give a two-week notice to terminate, and failure to do so will result in termination without bond refund.

If tenants choose to convert to a periodic contract, the rent will increase by $10 per week for a maximum of three months, after which a new fixed-term lease agreement must be signed. It is important to thoroughly review and understand these terms before signing the lease agreement.

 

4. Tenant’s Responsibility

4-1. Lease Termination: Otherhome may terminate your lease in case of issues such as racism, sexual assault and harassment, violence including verbal abuse, drugs, indoor smoking, pets without permission, and unauthorised children.

4-2. Parties: Parties are not allowed without permission from all other share mates. Prior notification using the Otherhome Chat Application is required. Invitees can stay for a maximum of 3 hours, but sleepovers are not allowed.

4-3. Noise and Disturbances: Tenants must not make any noises or disturbances between 10 pm and 7 am the next day.

4-4. Strike Policy: There is a strike policy before lease termination. The property management team will send an official warning letter to the tenant.

4-5. Rent Arrears and Violations: Rent arrears of a week will be receive a warning with the official letter. And more than 2 weeks without prior discussion, racism or any type of violence, and other mentioned issues can result in lease termination.

 

5. Cleaning

5-1. Weekly Cleaning Roster: Each tenant will be rostered for designated weekly cleaning of common areas. After cleaning, the tenant must upload photos of the cleaned area on the Otherhome group chat.

5-2. Cleaning Areas: Kitchen, common living areas, bathrooms (excluding those using ensuites), and individual rooms.

5-3. Failure to Clean: If tenants refuse or fail to clean on their assigned turn, Otherhome may give a strike and charge up to $150 for cleaning services if they need to hire or provide cleaning due to the condition of the house.

1-2. Maintenance and Repairs: Otherhome is responsible for promptly addressing maintenance and repair requests related to the rental property. However, please note that some maintenance issues may require approval from the landlord and scheduling of service, which may result in longer response times. Otherhome will make reasonable efforts to expedite the approval process and schedule repairs as quickly as possible, keeping tenants informed of the progress.

1-2-1. Otherhome maintenance team is not obligated to provide a notice for entry into common areas when visiting for repairs or inspections. (Notice is required for entry into individual rooms.)

1-2-2. Emergency Contact Information: In the event of emergencies such as fire, theft, flooding, or any other life-threatening issues, please contact us immediately at +61 448 496 534. Please note that only issues classified as emergencies will be addressed through this contact number. Any other issues that are not explicitly defined as an ’emergency’ within the lease agreement may be refused and not attended to.

1-3. Compliance with Laws and Regulations: Otherhome will ensure compliance with all applicable laws and regulations related to the rental property and tenancy. This includes adherence to local housing regulations, safety standards, and any other legal requirements that may apply.

1-4. Security and Privacy: Otherhome will take reasonable measures to protect the security and privacy of tenant information and ensure that any personal data is handled in accordance with applicable data protection laws.

1-5. Communication and Updates: Otherhome will provide regular updates and communication to tenants regarding any changes, important notices, or updates related to the rental property, lease agreement, or any other relevant information.

 

2. Installation of CCTV cameras

2-1. Privacy: CCTV cameras are installed solely for security purposes and to prevent crime.

2-2. Areas Covered: The cameras are installed only in public areas, and tenants are not allowed to change their position. In addition, cameras are not installed in private areas such as bedrooms or bathrooms. Please refer to the attached photos for exact locations.

2-3. Recording: All footage is stored for a maximum of one week and is automatically deleted thereafter.

2-4. Access: Only Otherhome personnel can access recorded footage, and it is provided to tenants only if there is a valid reason (e.g., police investigation).

2-5. Maintenance: All CCTV cameras are regularly inspected and maintained by Otherhome’s maintenance team.

2-6. Legal compliance: The installation of CCTV cameras complies with local laws and regulations, and Otherhome is not responsible for camera issues caused by battery problems or machine malfunctions.

 

3. Otherhome Messenger

3-1. Download and Login: Tenants are required to download the Otherhome Chat Application from either the App Store or Google Play store. They must log in using the provided ID and password issued by the Property Management Team.

3-2. Communication and Information: The Property Management Team will disseminate important information, such as electricity bills, cleaning schedules, and other updates, via the group chat on the application. Failure to utilize the chat application will result in the tenant assuming full responsibility for any negative consequences that may arise.

3-3. Account Creation: Upon signing the lease agreement, the Property Management Team will create an account for the tenant using the provided email address.

3-4. Group Chat Inclusion: The tenant’s new account will automatically be added to the relevant house group chat.

3-5. Instructions and Rationale: The Property Management Team will provide detailed instructions to tenants on how to use the chat application and explain the reasons for its use by all tenants.

 

4. Marketing Use of Personal Information

Otherhome reserves the right to utilize the personal information provided by tenants, including their name, email address, and phone number, for marketing purposes. By providing this information, tenants acknowledge and consent to its potential use for marketing and promotional activities. Otherhome ensures that tenant privacy is protected and handles personal information in compliance with applicable laws and regulations.

 

5. Loss and Theft

5-1. The loss of keys incurs a fee of $150 including the installation of a new knob if applicable. The loss of the apartment electronic fob incurs a fee of $150 for a key copy and delivery service.

5-2. In case you lock yourself out, an attendance fee is incurred ($100 – between 10 am and 5 pm). This service is not considered as ’emergency’ and is subject to our availability. If we are not available to attend (after business hours, weekends, public holidays, no spare key in the office), you need to arrange a locksmith or ask other tenants to come into the property.

5-3. Stealing others’ properties (i.e., dishwashing liquid, personal belongings, foods) is strictly prohibited. If involved, your tenancy will be terminated immediately, and we might charge you about the missing item and damage.

 

6. Miscellaneous

6-1. All facilities provided during check-in must meet the same condition at the time of check-out.

6-2. If any faults, damages, malfunctions, or breakages including shared facilities (e.g., provided cookware, provided furniture in the room) are discovered by Otherhome without any prior discussion, the expenses incurred to cover the damage will be shared by the tenants.

6-3. Tenants are responsible for any damages to features within each room (e.g., furniture, appliances, equipment, etc.)

6-4. Tenant must clean their room, common storage, en-suite bathroom (if applicable), fridge storage used, cupboard, and room furniture by check-out.

6-5. Check out process:

▪️ Check-out time is 10 am on the last day of the tenancy.

1) Please make sure to discard all bedding, including the quilt and pillows from Otherhome. You can bring them with you if you want. Once you’ve cleaned your room, please send us at least 8 photos from different angles via email. This will help us make sure everything is in tip-top shape for the next tenant. If we need to do additional cleaning, a fee of up to $150 may be deducted from your deposit. support@yydpni9u.dreamwp.com

2) If you have any outstanding electricity bills, we’ll deduct them from your bond. Let us know if you’d like to use the previous billing period or wait for the new bill for greater accuracy.

3) To ensure a smooth deposit refund process, please leave us your bank details. We’ll process the refund on the last Tuesday of each month.

4) Don’t forget to leave your key on the desk in your room and send us a quick photo. If you don’t, we’ll need to deduct a $150 key cutting fee. Also, when you leave your room, please make sure to leave the door unlocked. We don’t have a spare key, so if you lock it, we’ll need to charge you $150 for a replacement door and new key.

5) Finally, please give the fridge and pantry area a good cleaning before sending us a photo. This will help us keep everything for the next tenant. If we need to clean it ourselves, a $50 fee may be issued.

6-6. Tenant must provide Otherhome the exact move-out date at least 2 weeks before the end date of fixed term contract. If not, the contract will be changed to a Periodic contract automatically, which increases your rent by $10 per week, and continues for 3 months. After 3 months, the tenant must sign on the new lease agreement for the fixed term again.

6-7. Room transfer for any reason is allowed without breaking the lease. An administrative charge of $150 will be applied.

 

  1. Changes to these Terms: Otherhome reserves the right to modify these Terms at any time, with or without notice. Your continued use of the Otherhome Platform following any such modifications constitutes your acceptance of the revised Terms.

 

  1. These Terms, together with any additional terms and conditions that may apply to specific services provided by Otherhome, constitute the entire agreement between you and Otherhome and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Otherhome.

Terms and Conditions of Use

This website https://otherhome.org (Website) (including all subsidiaries), is owned, operated and maintained by Otherhome , Pty Ltd (Otherhome.com.au). Otherhome.com.au provides an online community that enables:

  1. People with accommodation looking for a tenant or co-tenant (Property Listers) to: a. Create a Listing for their rental properties by uploading Content; and b. Search Listings for people who are seeking to rent accommodation as a tenant or co-tenant; and
  2. People seeking to rent accommodation (Property Seekers) to: a. create a Listing for themselves by uploading Content; and b. search for rental properties and to get in contact with people who have accommodation to rent; (the Services).

By accessing, registering on and/or using the Website, or using the Services, you agree to be bound by these Terms and Conditions of Use.

Otherhome.com.au may, in its sole discretion, modify, vary, amend or revise these Terms and Conditions of Use (including, without limitation, any Services provided under these Terms and Conditions of Use) at any time, and you agree to be bound by those varied Terms and Conditions of Use. While Otherhome.com.au will endeavour to notify you of any major changes to these Terms and Conditions of Use from time to time, you agree that you will periodically review the most up-to-date version of these Terms and Conditions of Use.

In these Terms and Conditions of Use:

  • “Content” means graphics, photos, text, videos and location data relating to either available accommodation or a user who is seeking accommodation;
  • “Intellectual Property Rights” means copyright, patents, trade marks, designs and other statutory rights and all common law or equitable rights protecting business or personal reputation;
  • “Listing” means an online advertisement or promotion either: (a) promoting or offering rental properties or other accommodation for rent; or (b) seeking available accommodation to rent; and “Personal Information” has the meaning given to that term in the Privacy Act 1988 (Cth).
  • “Upgraded Services” include one of the following plans: Basic, Full, Pro-30 or Pro-12 month.
  1. LISTINGS

1.1 Users uploading Listings

  1. If you upload Content and/or create a Listing:
  2. you must ensure that such Content and Listings are true, correct and not duplicated;
  3. you must ensure that such Content and Listings are up-to-date at the time they are uploaded and are kept up-to-date for the duration of the time they are available on the Website;

iii. you must remove any Content and Listings as soon as reasonably practicable after either:

  1. the accommodation the subject of the Listing has been withdrawn from rent or after you have filled the vacancy for that accommodation, whichever is earlier; or B.the person identified in the Listing that is seeking accommodation has found accommodation and no longer needs to seek accommodation or no longer needs accommodation for whatever reason, whichever is earlier;
  2. you are solely responsible for making your own assessment of any user who contacts you in relation to any Listing and their suitability for the vacancy the subject of the Listing or the suitability of the accommodation (as applicable). Otherhome.com.au will not provide any information about any such users or assist you in any way in making your assessment by, for example, conducting any background checks that may be appropriate in respect of such users; and
  3. you must ensure that any proposed rental agreement between you and another person for accommodation abides by any Local, State, or Commonwealth laws relating to the provision or use of rental accommodation, including residential tenancy law, strata by-laws, and local government planning laws.
  4. If you use the Services in a way that breaches these Terms and Conditions of Use or we deem any Content or Listing on the Website to be unacceptable, Otherhome may take action remedy this, including but not limited to, amending or deleting the Content or Listing, adjusting access to your Account, terminating your Account or any other action that we determine appropriate in our sole and absolute discretion.
  5. If Otherhome.com.au determines that any Content or Listing has been inactive for 7 days or longer, it may remove that Content or Listing in its sole and absolute discretion.

d.Discretion is granted to Otherhome.com.au to delete, deactivate or edit any Content or Listings that are duplicated, breach our Terms and Conditions or are found to be inappropriate.

e.Otherhome.com.au does not make any representation or provide any warranty in respect of any user of the Website including, without limitation, any representation or warranty in respect of the suitability, behavioural characteristics of or creditworthiness of a user as a tenant or prospective tenant of any accommodation the subject of a Listing.

1.2 Users of the Website

  1. If you use the Website to browse or search Listings seeking accommodation or a prospective tenant to fill vacant accommodation:
  2. you are solely responsible for making your own assessment of the accommodation or user in any Listing or any user who has uploaded the Listing and their suitability for your needs. Otherhome.com.au will not provide any information about any users who have uploaded a Listing and will not assist you in any way in making your assessment by, for example, conducting any background checks that may be appropriate in respect of such users;

ii.you should inspect the accommodation that is the subject of any Listing and meet with any prospective tenants or co-tenants who are the subject of any Listing (as applicable) and/or the prospective landlord before making a decision whether or not to apply to rent or sub-rent any such accommodation; and

iii. you must ensure that any proposed rental agreement between you and another person for accommodation abides by any Local, State, or Commonwealth laws relating to the provision or use of rental accommodation, including residential tenancy law, strata by-laws, and local government planning laws.

  1. Otherhome.com.au does not make any representation or provide any warranty in respect of the Content of any Listing, of any user of the Website or any accommodation or users the subject of a Listing including, without limitation, any representation or warranty in respect of the suitability or behavioural characteristics of a user as a landlord, co-tenant or prospective landlord or co-tenant of any accommodation the subject of a Listing or the condition of any such accommodation.

c.Otherhome.com.au does not inspect any accommodation that is the subject of a Listing.

  1. Otherhome.com.au does not vet, question, or check any person who creates an Account on the Website. Otherhome.com.au does not conduct any identity or personal checks on any person who creates an Account on the Website.
  2. Otherhome.com.au does not vet, question, or check any person who is the subject of a Listing. Otherhome.com.au does not conduct any identity or personal checks on any person who is the subject of a Listing.

f.Otherhome.com.au does not vet, question, or check any person who creates a Listing offering accommodation, or any person who uploads Content for offering accommodation. Otherhome.com.au does not conduct any identity or personal checks on any person who creates a Listing offering accommodation, or any person who uploads Content for offering accommodation.

  1. Otherhome.com.au does not check, either by itself or through an independent third party, the truth, accuracy or completeness of any Content or the accuracy of any location details available in respect of a Listing including, without limitation, location details provided by use of Google’s Google Maps service. Your use of Google Maps is subject to theGoogle Maps Terms of Service and Google Privacy Policy.
  2. ACCOUNTS

2.1 Registration

  1. To publish Content, you must register with Otherhome.com.au by providing certain information to Otherhome.com.au including your name, email address and your mobile telephone number (Account).
  2. After creating an Account but before publishing Content, you must enter an activation code sent by Otherhome.com.au to your mobile telephone number.
  3. You represent and warrant that you are the account holder for the mobile telephone number provided to Otherhome.com.au when registering your Account.
  4. You must be 18 years or older in order to register an Account and create a Listing on our Website.
  5. You represent and warrant that the information you provide to Otherhome.com.au to open an Account is true and correct. If, at any time during the term of your Account, any of that information ceases to be true and correct, you undertake to notify Otherhome.com.au of the change to that information as soon as is reasonably practicable.
  6. Any personal information you provide to Otherhome.com.au will be treated in accordance Otherhome.com.au’s Privacy Policy available here: otherhome.com.au/privacy.
  7. You may not use another user’s Account, or allow anyone else to use your Account, without Otherhome.com.au’s express prior written permission.
  8. You are solely responsible for any activity which occurs on your Account.
  9. You must keep your Account details, including your password, Facebook login details and other other verification details, secure at all time and must immediately notify Otherhome.com.au of any breach, or any suspected breach, of the security of or unauthorised access to your Account.

2.2 Security checks

All listings and accounts on Otherhome.com.au are subject to security checks. When using the platform, you agree to be subject to these security checks, which may delay the activation of your listing or your account.

2.3 Termination

Otherhome.com.au may, in its absolute discretion, suspend or terminate your Account if:

  1. you breach or violate any term or condition of these Terms and Conditions of Use; or
  2. in Otherhome.com.au’s sole opinion, your ongoing use of the Service will bring, or may bring, the reputation of Otherhome.com.au into disrepute or cause Otherhome to be in breach of an applicable law.
  3. WEBSITE AND SERVICES

3.1 Use of Website and Services

You must not, and must not attempt to:

  1. use the Website for any purpose other than for the purpose of offering to rent accommodation or seeking to rent accommodation;
  2. use the Website or the Services in any way that causes, or is likely to cause the Website or access to it to be interrupted, damaged, rendered less efficient or in a way that impairs the effectiveness or functionality of the Website;

c.authorise any other person to do any act which would, if that act were to be done by you, infringe any Intellectual Property Rights or us, our licensors or third parties;

  1. reverse engineer, decompile, disassemble, modify, translate, or otherwise uncover the source code of any software forming part of the Website;

e.capture or copy any software on the Website for any reason whatsoever (temporary copies for facilitating a technical computing process excepted);

  1. hack, infiltrate or otherwise do anything which may compromise the Website;
  2. cause Otherhome.com.au to lose (in whole or in part) the services of Otherhome.com.au’s internet service providers (ISPs) or other suppliers;
  3. introduce any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority or expropriate any system, data or personal information;
  4. prevent or restrict us from complying with any applicable law, industry code or court order;
  5. use the Website or any of the Services for any improper or unlawful purpose, causing a nuisance or causing the operation of any of the Services to be jeopardised or impaired;
  6. use the Website or any of the Services to provide, to aid, abet, procure, counsel or assist another person to provide, or to encourage, solicit or entice the provision of, any services of a sexual nature for monetary or non-monetary consideration;
  7. use the Website or any of the Services to create, host or transmit any defamatory, offensive or obscene material or engage in activities which would cause offence to, insult, humiliate or intimidate others on the grounds of race, religion, creed, sex or gender, or sexual preference;
  8. use the Website or any of the Services to harm, or attempt to harm, persons (including persons under the age of 18 years) in any way;
  9. use the Website or any of the Services to create, host or transmit any material that threatens or encourages bodily harm or the destruction of property or would constitute a criminal offence or give rise to civil liability;

o.use the Website or any of the Services to create, host or transmit material which infringes the Intellectual Property Rights (including without restriction copyright, trade mark, patent, trade secret or other intellectual property rights) of any other party;

  1. use the Website or any of the Services to create, host or transmit unsolicited advertising material to other users;
  2. use the Website or any of the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent or to engage in screen scraping, database scraping or any other activity with the purpose of obtaining lists of users or other data;
  3. use the Website or any of the Services for any activity which adversely affects the ability of other people or systems to use the Website or any of the Services, or the Internet generally, including the uploading of files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer; or
  4. at any time while you are using the Website or any of the Services, impersonate any person or entity or use or provide a false name or a name that you are not authorised to use.

3.2 Access to Website and Services

Otherhome.com.au will attempt to make the Website and Services available for use 24 hours a day, 7 days a week. However, it will be necessary for Otherhome.com.au to take-down the Website and cease providing the Services for a period of time for regular maintenance and to make improvements and if circumstances beyond Otherhome.com.au’s control exist, such as problems preventing access to internet or webhosting services. In such circumstances Otherhome.com.au will incur no liability to you for such interruption or cessation of Services no matter how such liability would otherwise arise.

3.3 No advice

From time to time, Otherhome.com.au will make available on the Website articles and other material setting out information relevant to seeking accommodation or renting accommodation, such as articles relating to tenants’ rights as tenants (Informative Content). Any Informative Content on the Website is of a general nature only and does not consider your personal objectives, financial situation or particular needs. You should not regard Informative Content as advice and you should seek professional legal, property, accounting or other advice for your specific circumstances. You should not rely on any Informative Content as the basis for taking any legal action, negotiating or entering any agreement, or incurring any financial liabilities.

3.4 Upgraded Services

Property Listers

  1. In addition to the Free Services, Otherhome.com.au provides Upgraded Services which allow property listers to contact property seekers who have Listings within the “early-bird period” (the first 14 days from activation). Users of the Upgraded Service (provided they are mobile verified) can also access mobile numbers where available.
  2. Otherhome.com.au provides the following packages for Free and Upgraded Services for property listers:
  3. a free service, which permits a user to list a maximum of 1 active property listing at any one time;
  4. a Basic Upgraded Service, which provides access to the Upgraded Services for 10 days from and including the date of registration for the Upgraded Service and permits a user to list 1-2 active property listings for a period of 10 days;

iii. a Full Upgraded Service, which provides access to the Upgraded Services for 30 days from and including the date of registration for the Upgraded Service and permits a user to list 1-2 active property listings for a period of 30 days;

  1. a Pro-30 day Upgraded Service, which provides access to the Upgraded Services for 30 days from and including the date of registration for the Upgraded Service and permits users to list 3 or more active property listings and
  2. a Pro-12 month Upgraded Service, which provides access to the Upgraded Services for 12 months from and including the date of registration for the Upgraded Service and permits users to list 3 or more active property listings
  3. If you upgrade to a Full Upgraded Service and you do not find a suitable tenant from a Listing for available accommodation during your 30-day upgraded period, you will automatically receive a further 30 days of use of the Upgraded Service provided that you:
  4. have at least one live property Listing for the duration of the term of the Full Upgraded Service; and
  5. your account is active. If your account is inactive, you must apply to Otherhome for the guarantee within 7 days of your account expiring at support@yydpni9u.dreamwp.com.

Property Seekers

  1. In addition to the Free Services, Otherhome.com.au provides Upgraded Services which allow property seekers to contact property listers who have Listings within the “early-bird period” (the first 14 days from activation). Users of the Upgraded Service (provided they are mobile verified) can also access mobile numbers where available.
  2. Otherhome.com.au provides the following packages for Free and Upgraded Services for property seekers:
  3. a free service, which enables the property seeker to contact a property lister outside of the “early-bird period” (the first 14 days from activation);
  4. a Basic Upgraded Service, which provides access to the Upgraded Services for 10 days from and including the date of registration for the Upgraded Service and permits the property seeker to contact a property lister at any time after a property Listing is activated;

iii. a Full Upgraded Service, which provides access to the Upgraded Services for 30 days from and including the date of registration for the Upgraded Service and permits the property seeker to contact a property lister at any time after a property Listing is activated.

  1. If you upgrade to a Full Upgraded Service and you do not find suitable accommodation from a Listing during your 30-day upgraded period, you will automatically receive a further 30 days of use of the Upgraded Service provided that your account is active and your property seeker Listing was live for the duration of your Full Upgraded Service.
  2. All payments for access to Upgraded Services are processed by Stripe or Braintree (a PayPal company). Otherhome.com.au does not store credit card details.
  3. Once a payment for access to Upgraded Services is complete, you will get immediate access to the Upgraded Services and Otherhome.com.au will not refund any such payment under any circumstances including, without limitation, if Otherhome.com.au terminates your Access to the Website or the Services for breaching these Terms and Conditions of Use. However, a user may be eligible for a discount on any future Upgrade Service in accordance with clause 3.4(k).
  4. Otherhome.com.au does not guarantee that you will find accommodation to live in if you are searching for accommodation, or find a tenant or co-tenant if you are offering accommodation, by virtue of access to an Upgraded Service.
  5. Otherhome will notify a user 48 hours before an Upgrade Service is due to expire. If the user does not purchase a new Upgrade Service by the expiry date, the user will only be able to list the most recently activated Listing on Otherhome.
  6. If a user upgrades to another plan during their original service, Otherhome will apply a “pay the difference” feature. For example if a user moves from a Basic Upgraded Service to a Pro-30 day Upgraded Service the remaining value of the Basic Upgraded Service will be applied as a discount to the new Pro-30 day Upgraded Service.
  7. Otherhome.com.au may allow users to pause or suspend their Upgraded Services in its absolute discretion.

Clause 3.5 – Boost Services

  1. In addition to the free and Upgraded Services, Otherhome.com.au offers Boost Services which rank a user’s boosted property listing in one of the top eight spots of its suburb room search results for seven days from and including the date of registration for the boost for a fee (Boost Services).
  2. Only members listing a property with an Upgraded Service are eligible to purchase Boost Services. Boost Services are limited to eight listings per suburb at any one time.
  3. A boosted listing is available for a total of eight listings per suburb. If all eight boosted listings have been exhausted for a particular suburb, you will not be able to purchase a Boost Listing until there is a position available.
  4. All payments for access to Boost Services are processed by Stripe or Braintree (a PayPal company). Otherhome.com.au does not store credit card details.
  5. Once a payment for access to Boost Services is complete, your boosted listing will be ranked in one of the top eight spots for its suburb room search results for seven days from and including the date of registration. The ranking within boosted listings for a suburb is based upon the most recently boosted listing for that suburb. Otherhome.com.au will not refund a Boost Listings payment under any circumstances including, without limitation, if Otherhome.com.au terminates your Access to the Website or the Services for breaching these Terms and Conditions of Use.
  6. If your listing is undergoing a Otherhome security check the listing may temporarily be unavailable on our site. If this is the case, your Boost Service will be paused for the time it was not available and the expiry date of your Boost Service will be extended to cover this period of delay.
  7. CONTENT

4.1 Uploading of Content

  1. As part of the Services, the Website allows you to upload Content for viewing by other users of the Website as part of a Listing. Each time you upload Content to the Website, you confirm your acceptance of, and your agreement to be bound by, all the terms and conditions set out in these Terms and Conditions of Use.
  2. Otherhome.com.au will not review, vet or approve, and is not responsible for reviewing, vetting or approving, the Content or any part of the Content, or any material appearing in the Content, and it is the sole responsibility of the user uploading the Content to ensure that the Content or any part of the Content, or any material appearing in the Content, complies with these Terms and Conditions of Use.

4.2 Rights to the Content

At the time you upload Content, you represent and warrant that:

  1. you are the owner of all Content and all Intellectual Property Rights in and to the Content and all material appearing in the Content, or you otherwise have the authorisation, permission or consent of the owner of, or any other relevant person to, the Content or any part of it or any material appearing in the Content;
  2. you have the authorisation, permission or consent of each person appearing in the Content for them to appear in the Content and for you to submit that Content, make the Content available on the Website and otherwise grant the rights to Otherhome.com.au you grant under these Terms and Conditions of Use;
  3. the Content or any part of it, or any material appearing in the Content, does no infringe the rights, including any Intellectual Property Rights, of any third party; and
  4. the Content does not contain any material which is offensive, defamatory, discriminatory, pornographic, abusive, obscene, or otherwise illegal in any jurisdiction anywhere in the world.

4.3 No endorsement

Otherhome.com.au does not endorse any Content or Listing uploaded to the Website by you or any user, or any opinion, recommendation or advice expressed in the Content or Listing.

4.4 Ownership

Otherhome.com.au acknowledges and agrees that no right, title and interest in and to the Content you submit to the Website is transferred to Otherhome.com.au and that it has no rights in respect of that Content except those rights granted to it under these Terms and Conditions of Use or otherwise in writing by you.

4.5 Licence

At the time you upload Content, you grant to Otherhome.com.au a non-exclusive, royalty-free, worldwide, irrevocable, perpetual licence to host, cache, store, maintain, use, reproduce, communicate, distribute, display, exhibit, perform, publish, broadcast, transmit, modify, prepare derivative works of, adapt, reformat, translate or otherwise exploit all or any part of the Content on the Website and any other Website which is associated with, connected to, or otherwise operated by Otherhome.com.au including, without limitation, websites owned and/or operated by persons other than Otherhome.com.au.

4.6 Take-down or modification of Content or Listing

Otherhome.com.au, in its sole and absolute discretion, may edit, modify, block or delete any Content or any Listing, or any comments or messages made on the Website in respect of a Listing, if Otherhome.com.au determines that any of the preceding material contravenes or is likely to contravene these Terms and Conditions of Use.

4.7 Release

You forever release Otherhome.com.au, and its directors, officers, employees, agents and contractors, for any and all claims, rights, demands, actions or suits which you have, may have or would have had, in connection with Otherhome.com.au’s exploitation of the Content or the exploitation of the Content by any of Otherhome.com.au or its directors, officers, employees, agents or contractors and whether that claim arose or arises in contract, tort (including, without limitation, negligence), under statute or otherwise.

4.8 Waiver

You hereby consent to all acts or omissions by Otherhome.com.au, its licensees or others authorised by it, or its successors in title, which would otherwise constitute an infringement of any moral rights you have, or may have, in the Content or any part of it, or any material appearing in the Content, whatsoever and wheresoever subsisting throughout the world. You acknowledge that such consent is provided genuinely and includes consent for Otherhome.com.au, or any other person authorised by Otherhome.com.au, to materially alter, modify, add to and in any way change the Content or any part of it, or any material appearing in the Content, and deal with the Content or any part of it, or any material appearing in the Content, without identifying you or any third person as the author of the Content or any part of the Content, or any material appearing in the Content. You warrant that any third party who has acquired any moral rights in the Content or any part of it, or any material appearing in the Content, has also waived his or her moral rights or consented to all acts or omissions (as applicable) on terms similar to the terms set out in these Terms and Conditions of Use.

You acknowledge and agree that all rights in the Website and all material comprised in the Website (including, but not limited to, Intellectual Property Rights, text, images, web pages, sound, software (including, code, interface and website structure) and video, and the look and feel, design and compilation thereof) (Website Content), excluding the Content, are owned by Otherhome.com.au or the supplier of the relevant material.
